Some laws these days :shock: its peoples fault for not securing it….but some things like psp and ds hate wep so : (. That cop must of had nothing better to do unless that person saw what he was doing and called the police. Theres alot more crimes that cops should go investigate instead of minor ones like these. But of course if you jack into wep system then ya you should get fined but I guess people are into “hey thats mine dont touch it” even though its right in front of you(unsecored WIFI).

You are kidding right? ...about the ‘its people fault’ comment. You can’t be serious…so if i leave my door unlocked at night, it’s OK for some punk to walk in and steal my DVD collection or rifle thru my taxes…
All because the door is open, or unlocked, doesn’t give you the right to walk in, same goes for WIFI connections…you better know good and well you are connecting to a hotspot and not somebody’s home connection. While it’s a good idea to know what you are doing before you go wireless…not everybody does…but that doesn’t give an automatic ‘by’ to every ‘under 18’ video game junky in the neighborhood to hop on and surf for porn.
Second of all, it’s the same as stealing cable…so there don’t need to be any new laws to cover this…the local cable company will take care of it if you turn somebody in w/ proof…unless it’s DSL or SAT, but I’m sure they have a clause to cover it as well.
Last, if you are stupid enough to jump onto an unsecured network, go for it…you never know who or what might be waiting on the other side…might find yourself with a nasty worm or virus…never know when it’s somebody deliberately trying to DUPE you into connecting to their network.

It’s really not all black and white. My neighbour has an unsecured wireless network that is still called default and for some reason my powerbook just loves to connect to it. I have my own (well secured network) and I of course just tell the ‘book to get off and login to my own network but a couple of times I have just fired up the computer, gone to make a coffee or whatever and it’s connected. I come back, start surfing the web and then remember and then logoff his and onto my own.
So am I to be fined/locked up or whatever because i accidentally logged onto some fools unsecured network? It’s not like walking into an unlocked house, i mean come on, there’s trespassing. But the wireless network is actually in my house! I can’t avoid trespassing on it. Like if you owned a gate in the middle of the road and you left it open and i driove through it? Bad analogy for sure but there’s so many instances. How about you put up a sign on you house and ban people from looking at it, do I have to avert my eyes as i walk past or it’s my fault?
It’s not black and white and the simplest way (and possibly best on a number of levels) is to make it user beware ad if it’s unsecured well it’s on your own head.

I have yet to see any law saying accessing an unsecure wifi signal while being in a public place is a crime. Many have ranted it’s a crime, but none have been able to show what law is being violated. I’m not talking about breaking the security encryption or accessing someone personal data; I’m talking only the use of the wifi to access the internet. Anyone saying it’s a crime please include the code section.

On the state level it could be more clear. “It’s unlawful access”, said John Geraty, an officer with the Internet crimes against children unit of the San Francisco Police Department.
According to Geraty, using your neighbor’s wireless is specifically prohibited in the California penal code. “It’s not yours and you’re taking it,” he says.
There are plenty of ways for them to charge you…either stealing from the cable company {getting service without payment (even if someone else is paying)} or stealing directly from your neighbor.
This man pled guilty to “remotely accessing someone else’s computer system without permission”, it’s not something they made up on the fly.
Yup, like I said, a lot of folks who feel absolutely positive this is a crime, but not one has yet been able to provide a code number. I like the one of the officer saying it’s specifically prohibited in the Calif. Penal Code and saying “it’s not yours and you’re taking it”. Taking what??? I’m waiting for the day when homes with solar collectors will be billed for using the suns rays by saying it’s not yours and you’re taking it.
In reference to the Illinois man, I suspect he did more then just simply access the wifi. He could have accessed child porn, sent threatening emails, accessed someone’s personal data, etc. The newspapers don’t always report accurately.
The closest we have to wifi access being a crime in California is penal code section 502. You can read it here if you click the box for penal code and type 502 in the search engine. The real barrier to wifi access being a crime has to do more with the FCC, who ruled long ago that whatever transmission you receive in your home (or place you are lawfully allowed to be at) is yours to freely receive. The gray area is that you’re receiving device is also a lawful transmitter, that is as long as it’s not transmitting anything, shall we say, malicious. We may yet see some California law enforcement agency try to charge a wifi only user with section 502. If so I could see this going up to the California Supreme Court for a ruling.
